A. Order acceptance

Placing an order is an offer to purchase. We may accept, decline, or cancel an order for reasons including, but not limited to:

  • Suspected fraud or unauthorized transactions

  • Shipping limitations

If we cancel after your payment is processed, we will issue a refund to your original payment method.

Prices are listed in USD unless stated otherwise. Prices and promotions may change at any time without notice.

C. Taxes

3) Shipping and delivery

We ship to the locations shown at checkout. Estimated delivery times are not guaranteed and may be affected by carrier delays, customs, weather, or other factors outside our control.

Title and risk of loss pass to you upon delivery to the carrier, to the extent permitted by law.

4) Returns, refunds, and exchanges

Return window: You may request a return within 90 days of delivery.
Return condition: Items must be unused, in original condition, and in original packaging (including all components, inserts, and accessories).
Non-returnable items: Gift cards and any items marked final sale (and any other items prohibited by law).
Return shipping: Customer pays return shipping.
Refunds: Approved refunds are issued to the original payment method after we receive and inspect the return.
Exchanges: We do not offer exchanges.
Damaged or incorrect items: Contact us within [90] days of delivery with photos so we can make it right.

5) Product information and disclaimers

We try to display product colors, materials, and details as accurately as possible. However, differences in screens, lighting, and manufacturing may cause slight variations.

To the fullest extent permitted by law, the Site and products are provided “as is” and “as available,” without warranties of any kind except as required by law.

 

6) Promotions, discount codes, and gift cards

Discount codes:

  • Must be used as stated and may not be combined unless explicitly allowed

  • May exclude certain items

  • Have no cash value

Gift cards:

  • Are non-refundable (unless required by law)

  • Cannot be exchanged for cash

  • May have additional terms shown at purchase

7) Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activity under your account. We may suspend or terminate accounts for suspected misuse or security concerns.

8) Intellectual property

All content on the Site (text, images, logos, product names, designs, graphics, and software) is owned by or licensed to Evasea and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without written permission.

9) User content (reviews, comments, submissions)

If you post reviews, comments, photos, or other content:

  • You represent you own or have rights to the content

  • You grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute it for marketing and operational purposes

  • You agree not to post unlawful, defamatory, harassing, or infringing content

We may remove content at our discretion.

10) Prohibited conduct

You agree not to:

  • Attempt to gain unauthorized access to the Site or systems

  • Use bots/scrapers that overload the Site

  • Transmit malware or harmful code

  • Commit fraud, chargeback abuse, or misuse promotions

  • Infringe on intellectual property rights

11) Limitation of liability

To the fullest extent permitted by law, Evasea will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or related to your use of the Site or products.

Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.

You agree to indemnify and hold harmless Evasea and its owners, employees, and service providers from claims, damages, liabilities, and expenses arising from your breach of these Terms or misuse of the Site.
